AGREEMENT BETWEEN OSHKOSH PUBLIC LIBRARY
AND OSHKOSH PUBLIC LIBRARY EMPLOYEES

Agreement
This agreement made and entered into by and between the Oshkosh Public Library, Oshkosh, Wisconsin, hereinafter referred to as the Library, and the Oshkosh Public Library Employees, Local 796-A, American Federation of State, County, and Municipal Employees, AFL-CIO, hereinafter referred to as the Union.
Article I - Recognition
The Library hereby recognizes the Union as the exclusive bargaining agent for all regular full-time and regular part-time employees of the Oshkosh Public Library, but excluding Librarian I, II, III, IV, Supervisory, confidential personnel, and casual hourly employees.
Section 1. The Library recognizes the right of the Union to represent the employees covered by the unit of representation in conferences and negotiations with the Library, or its lawfully authorized representatives, on questions of wages, hours, and conditions of employment.
Section 2. The Library agrees not to discriminate against, threaten, or coerce employees in the exercise of their rights provided in Wisconsin Statute III.70.
Section 3. The Union agrees not to discriminate against, threaten, or coerce employees in the exercise of their rights provided in Wisconsin Statute III.70.
Article II - Representation
Section 1. The Union shall be represented in all such bargaining or negotiations on questions of wages, hours or conditions of employment with the Library by such representatives as the Union may designate.
Section 2. The Library shall be represented in such bargaining or negotiations on questions of wages, hours, or conditions of employment with the Union by such representatives as the Library may designate.
Section 3. Both parties shall meet and bargain in good faith at such mutually agreeable times.
Article III - Rules & Regulations
Section 1. The Library may adopt and publish rules which may be amended from time to time, provided, however that such rules and regulations shall be first submitted to the Union for its information, prior to the effective date.

Section 2. Rules and regulations shall become effective on the day following the fifteenth (15th) day of submission to the Union. In the event of disputes as to such rules or regulations, the dispute shall be referred to the grievance procedure for settlement and shall be initiated at the level of their origin. All rules shall bear the signature of the Library Director.
Article IV - Union Activities
Section 1. The Union agrees to conduct its business off the job as much as possible. This article shall not operate as to prevent a steward or Union official from the proper conduct of any grievance in accordance with the procedure outlined in this Agreement nor to prevent certain routine business such as posting of Union notices.
Section 2. Business agents or representatives of the Union having business with the officers or individual members of the Union may confer with such officers or members during the course of the work day for a reasonable time, provided that permission is first obtained from the supervisor in charge of such officers or members, and such period of time does not disrupt the orderly operation of the facility.
The Library agrees not to deduct such reasonable time from the pay of such employees, nor shall the Library be required to pay for time spent outside of the normal work day.
Section 3. Negotiations. If such negotiation meetings are conducted during working hours and are called by the employer, such time shall not be deducted from the pay of the designated Union representatives, nor shall the Library be required to pay for time spent outside of the normal day.
Section 4. Space shall be provided on bulletin boards for the proper notices of the Union.
Article V - Grievance Procedure
A grievance shall be defined as a violation of a specific article of this contract. All grievances shall state the facts involved and the article of the contract the employee feels is being violated, a clear and concise statement of the issue involved, the proposed remedy, the employee's and/or Union officer's signature and date. To insure an orderly disposition of differences arising out of this agreement between the Library and the Union and employees, this procedure shall be followed.
General. A grievance must be filed within fourteen (14) calendar days of the first occurrence of the incident, or knowledge of such occurrence, whichever is later.

Step 1. The aggrieved employee may present the grievance to his steward. The employee and the steward shall attempt to resolve the grievance with the immediate supervisor, who may consult with higher authority. The immediate supervisor shall state his position orally to the individual(s) who brought the grievance to his attention within seven (7) calendar days. The supervisor's answer shall settle the grievance unless within seven (7) calendar days the Union advances the grievance to Step 2.
Step 2. The Union shall submit the grievance in writing to the Library Director and/or his appointed representative. The Library Director and/or his appointed representative may meet with the aggrieved employee and the Union. The Library Director and/or his appointed representative may request participation of other management personnel. The Library Director and/or his appointed representative shall state his position in writing within seven (7) calendar days to the employee and the Union. Within seven (7) calendar days after receipt of the Library Director's and/or his appointed representative's statement, the Union shall advance the grievance to Step 3, or the matter shall be considered settled by all parties.
Step 3. The Union shall notify the Library Director and/or his appointed representative in writing of the intention to submit the grievance to arbitration as outlined in Section III.70 of the Wisconsin Statutes.
Step 4. Prior to filing for arbitration, the parties shall each select three (3) arbitrators from the Wisconsin Employment Relations Commission staff. From those six (6) arbitrators, five names shall be drawn. The parties shall then proceed to alternately strike from that panel until an arbitrator is selected. The striking order shall be determined by a coin toss. The decision of the arbitrator shall be final and binding on both parties, subject to judicial review. The arbitrator shall have no power to add to, subtract from, modify or extend terms of this agreement. The cost of the arbitrator shall be divided equally between the Union and the Library. The aggrieved party and up to three representatives of the Union may be present without loss of pay.
Article VI - Classifications - Employment Status
Section 1. The Library reserves the right to determine the table of organization, the number of employees to be assigned to any job description classification, and the job description classifications needed to operate the facilities. The Library shall notify the Union of any change in the table of organization.
Section 2. The Employer shall notify the Union of all positions which will be required to have a Commercial Drivers License (CDL) and the specific endorsement(s) required for each position.
Section 3. All employees shall be classified upon employment, and the Union shall be informed of the classification. The Union shall be notified of any change of status of an employee.

Section 4. Temporary Employee is one who is hired for a period not to exceed one hundred twenty (120) calendar days. Such employees shall not be subject to the provision of this agreement, provided they are not employed beyond the above mentioned one hundred twenty (120) day period. Should a temporary employee be employed beyond the one hundred twenty (120) day period he shall be termed a permanent employee and credited with full contract rights and compensation retroactive to his first day of employment.
Temporary employees filling in for employees on medical or military leaves of absence may be extended beyond the one hundred twenty (120) calendar day limit for additional periods of up to one hundred twenty (120) calendar days by mutual agreement of the Library and the Union. Such extended temporary employees shall be eligible for the following fringe benefits in accordance with the provisions of the contract from the ninety-first (91st) day of employment through the duration of extended temporary employment. The benefits shall consist of vacations, holidays, sick leave, emergency leave, medical plan, and retirement fund contributions.
Section 5. Permanent Employee is one who is hired to fill a permanent full-time or permanent part-time position in the table of organization. All such employees shall serve a probationary period of one hundred twenty (120) calendar days. Any employee returning to his or her former job within two (2) years of termination shall be required to serve only a 90 calendar day probationary period. The probationary period may be extended by mutual agreement between the Library and the Union. During the probationary period the Library may dismiss such employees without recourse to the grievance procedure. Permanent part-time employees shall accrue benefits on a prorated basis.
Article VII - Seniority - Lay Offs
Section 1. Seniority shall consist of the total calendar time elapsed since the date of employment and continuous employment. Seniority shall terminate upon discharge or resignation.
Section 2. In the event of lack of work or lack of funds, employees within the classifications affected shall be laid off in inverse order to the length of service, provided that the remaining employees can adequately perform the duties so that the Library's service to the public is not adversely affected. The affected employee(s) shall have the right to exercise his/her seniority by bumping into a lower paying classification for which he/she is qualified. The last employee laid off shall be the first to be called back from such lay off. Permanent full-time and permanent part-time employees shall not be subject to lay off until all temporary and probationary employees within the classification affected are laid off. A permanent employee faced with a lay off shall have the option to exercise his/her seniority by displacing any temporary employee who is filling a position for which the permanent employee is qualified for as determined by the qualifications listed in the applicable class specifications. Salaried employees shall be laid off in the above manner rather than having their hours reduced.

Section 3. If a lay off under consideration is to be a reduction-in-force lay off, the Employer shall give the Union forty-five (45) days notice on permanent full-time and permanent part-time positions. Employees may be temporarily transferred from one department to another without loss of seniority or other rights in their department of origin.
Section 4. Employees on lay off status shall be given twenty-four (24) hours of notice of recall for temporary employment without losing the right to permanent recall. Any employee not recalled from lay off shall be entitled to pay from the date any other person was hired in his stead. Any employee recalled on a permanent recall shall have the right to return to duty status within the period of notice required by his then employer. If any employee fails to return to his job upon being recalled, his employment shall be terminated. Employees on lay off status shall have rights to permanent recall for a period of eighteen (18) months from the date of lay off. All rights to permanent recall shall expire at the end of this period. Notice of such permanent recall and/or terms of employment shall be furnished to the Union.
Article VIII - Promotions - Job Posting - Transfer Policy
Section 1. A vacancy shall be defined as a job opening not previously existing in the Table of Organization or a job opening created by the termination, promotion or transfer of existing personnel when the job continues to exist in the Table of Organization.
Section 2. All non-supervisory vacancies not filled through the transfer policy shall be posted on the bulletin board for a period of seven (7) calendar days. Employees interested in such jobs shall sign the posted notices. All applications for such positions must be submitted to the Office of the Director before the end of the posting period. Employees may not sign job postings for jobs within their own classification, unless said posted job is for more or less scheduled hours than the job which the employee is presently performing, or unless the employee has been in his/her current position for at least one (1) year. A copy of each job posting shall be given to the Union. Postings will have salary range attached and an employee moving into a higher classified position shall be paid within the new range at the rate immediately higher than the one he is receiving at the time of promotion. Postings shall list the location and department of the position in addition to the classification.
Section 3. The employee shall be selected on the basis of seniority, work record, and qualifications. In the event an official training program has been conducted for a given position, successful completion of the program shall be the qualifying factor for promotion.
Section 4. Current employees who are promoted shall be required to serve a probationary period of ninety (90) calendar days. During the probationary period the employee may return to his former position without loss of seniority. Upon completion of the ninety (90) calendar day probationary period the employee shall either be classified as permanent or shall be returned to this former position. The probationary period may be extended by mutual agreement between the Library and the Union.

Section 5. Transfer Policy. Management reserves the right to make transfers within the Library system which in its opinion would expedite and improve the operation of the Library. The Union reserves the right to file a grievance on any transfer that is made for arbitrary or capricious reasons. The Union shall be notified in writing, regarding the reason and effective date of all transfers, through the Change of Status procedure, in accordance with Article VI, Section 2 of this Agreement.
Section 6. If the Library chooses to use a permanent employee to fill a temporary vacancy created by the absence of another permanent employee, said vacancy shall be filled through the posting procedure.
Article IX - Suspension - Demotion & Dismissal - Warnings
Section 1. The Library may suspend an employee without pay for just cause. The Library shall furnish the suspended employee with a written notice stating the duration of the suspension and the reasons for the action.
Section 2. The Library may demote an employee to a lower classification for just cause. The Library shall furnish the demoted employee with a written notice of such action and the reasons for same.
Section 3. The Library may discharge an employee for just cause. The Library shall furnish the discharged employee with a written notice of the action and the reasons for same.
Section 4. The Library may orally warn an employee for just cause. Should the situation persist the Library may issue a written reprimand.
Section 5. Disputes arising under this article may be subject to the grievance procedure. The Union will be provided with a copy of all written discipline and reasons for same. An employee shall be given advance notice that a meeting called by the Library may result in discipline. An employee, upon request, may have Union representation during a meeting called by the Library that may result in discipline.

Article X - Rest Periods
Section 1. Supervisors will schedule rest periods or establish guidelines under which rest periods are to be taken. Rest periods are based on hours worked, not hours paid. Breaks may not be accumulative.
Section 2. Employees shall be granted rest periods on the basis of the following schedule:
No rest break for up to 2 hours work.
More than 2, up to and including 3 hours work per day: 10 minutes.
More than 3, up to and including 5 hours work per day: 15 minutes.
More than 5, but less than 7.5 hours work per day: 20 minutes.
Article XI - Jury Duty
An employee scheduled for jury duty shall pay to the library a percentage of his or her jury duty check equal to that fraction of a normal work day for which the employee would otherwise have been scheduled. The employee shall continue to receive his or her full pay for the time lost while serving.
Article XII - Authorized Absence
Section 1. Vacation. All permanent full-time employees shall be granted vacation leave with pay at their classification rate of pay during the current calendar year prorated upon the amount of time they were employed in the previous calendar year as applied to the following schedule. Effective January 1, 2003, the calendar year, for vacations, shall be defined as February through January.

Permanent part-time employees shall be granted vacation leave as per the above schedule based upon the percentage of their status as applied to full-time employment. Length of service is considered to be continuous calendar years of service. Vacations shall not be accumulative from year to year. Subject to staffing requirements as determined by the Library, employees shall be given their choice of the time of vacation within the respective departments, except that if there is a conflict the employee with the greatest seniority shall be granted the first choice of vacation leave. Effective March 5, 1984, all full and part-time (except hourly employees) shall receive vacation based upon previous year's work notwithstanding up to 15 days Leave Without Pay or 90 working days Medical Leave, Leave Without Pay or Maternity Leave. Hourly employees shall receive vacation based upon previous year's hours worked as that relates to a full-time employee.
When a paid holiday occurs during a vacation period, the employee shall be granted an additional day of leave or at the option of the Library, an additional day's pay in lieu of the holiday.
Upon separation, employees shall be paid for all vacation due in proportion to time worked. In the event of separation, for any cause, prior to the completion of one (1) year of service, no terminal vacation shall be paid.

Section 2. Holidays. All permanent full-time employees shall be granted the following holidays as leave with pay: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Eve Day, Christmas Day, and an additional 32 hours for regular full-time employees, prorated for regular part time, to be taken and scheduled on the same basis as vacation. These floating holidays shall be earned at the rate of 2 2/3 hours per month not to exceed 32 hours. When a part-time employee works extra hours, over and above their normal work schedule, they will earn an additional, prorated amount of floating holiday time. This additional time will be credited to the affected employee for use in the following calendar year. Employees who terminate shall receive such additional time on their final pay check.
Any of the above holidays that are celebrated on a Monday by the federal or state governments shall be celebrated under this agreement the same day.
When any of the above mentioned days fall on a Sunday, the following Monday shall be deemed a holiday.
When any of the specified "holidays" fall on a regularly scheduled off-day the employee will be granted a day-off in lieu of the holiday. Such alternate day-off to be determined through mutual consent of the Library and the employee and is to be taken within three (3) months of the holiday involved.
All permanent part-time employees shall be granted the above holiday provision as applied to their work schedule.
In order to qualify for said holiday benefits, employees must work their scheduled shifts prior to and following the holiday, unless on authorized leave.
Hourly employees are specifically excluded from holiday leave provisions since they are not scheduled for work on any of the specified holidays.
Section 3. Sick Leave. All permanent full-time and part-time employees shall be granted sick leave credits based upon their work schedule according to the following provisions:
All regular full-time employees shall accumulate sick leave with pay at the rate of eight (8) hours for each month of service. All regular part-time employees shall accumulate sick leave with pay on a prorated basis, however, there shall be a minimum of three (3) hours for each month of credited service. For purposes of this section, leave without pay shall not be considered service. The recording of sick leave accumulation, and its use shall be in hours. Unused sick leave credits shall accumulate to a maximum of twelve-hundred (1,200) hours for regular full-time and part-time employees. Employees qualified to receive sick leave compensation shall receive such compensation at the rate of their regularly scheduled rate of pay.

Report prior to the start of each work day to his department head for his absence.
-
Keep his department head informed of the condition, and estimated day of return to work.

Submit a doctor's certificate for such absence upon request of the Library, stating the nature of the illness or injury and whether or not the employee has been incapacitated for said period of absence.

Apply for such leave according to the rules of the Library, on such forms as supplied for that purpose.
Sick leave should be regarded by all as a valuable, free health and welfare insurance which in the best interest of all concerned should not be used unless a legitimate need exists. Sick leave is not a "Right," like a vacation: It is a privilege, to be used carefully. Records of individual sick leave shall be maintained by the Library. It is permissible under this article to use sick leave for the purpose of an employee keeping medical and dental appointments.
If an employee uses one (1) day (8 hours) or less of sick leave in a calendar year, the employee's vacation account will be credited with one (1) day (8 hours) to be used in the subsequent calendar year. This benefit will be prorated for part-time employees.
Upon retirement under Wisconsin Retirement System, or death, the employee (or employee's beneficiary in the case of death) shall be paid 1/2 of his/her unused, accumulated sick leave. The maximum to be paid out shall be no more than six hundred (600) hours.
Section 4. Emergency Leave. Each permanent full-time and part-time employee shall be allowed up to four (4) working days off with pay in the event of the death of such employee's mother, father, spouse, son, daughter, father-in-law, mother-in-law, brother, sister, brother-in-law, sister-in-law, stepchild, stepfather, stepmother, and grandparents of employee, and shall be allowed up to two (2) working days off with pay in the event of the death of a grandchild, son-in-law, and daughter-in-law. Employees may apply for such leave in accordance with the rules of the Library. Funeral leave without pay will be permitted by the library to attend funerals of the employee's aunts, uncles, nieces, and/or nephews.

No funeral leave will be paid to any employee while on sick leave, lay off, or any unpaid leave of absence.
Section 5. Military Leave. Employees who are called or volunteer for military service shall be granted leave without pay upon application, provided the employee applies for re-employment within ninety (90) days of discharge. Dishonorable discharge shall be cause to void this section. Employees who are members of the National Guard or Military Reserve shall be granted temporary leave without pay or at the option of the employee, vacation leave may apply.
Section 6. Worker's Compensation. Employees shall be entitled to Worker's Compensation in accordance with Wisconsin Statute 102. At the option of the employee, he may apply for sick leave benefits to supplement Worker's Compensation to the extent that his full normal weekly gross wage is maintained. In no case shall Worker's Compensation and sick leave pay exceed the normal weekly earnings of the employee.
False claims for Worker's Compensation shall be processed in accordance with Wisconsin Statute 102.
The Library shall continue its contribution toward health insurance while an employee is on a Temporary Total or Temporary Partial Disability under Worker's Compensation.
Section 7. Leave Without Pay. Applications for leave of absence without pay shall be made in writing to the department head, stating period of such leave, and reasons for same. Disposition of such requests will be made on the basis of staffing requirements of the facility. Leave to attend union conventions, conferences or special Union meetings shall be considered one form of leave within the meaning of this section.
Leave without pay will be granted for medical reasons subsequent to receipt of a written request, a written statement from the physician(s) involved, and provided that staffing permits. Such leave will be granted for no more than ninety (90) working days initially, but may be extended for additional periods of up to ninety (90) working days by mutual agreement of the Library and the Union.
Section 8. Pregnancy Leave. Whenever an employee becomes pregnant, she shall furnish the Library with a medical report, stating the expected date of delivery and what, if any, work restrictions exist. Continued employment shall be based upon physical ability to perform the work. Upon request, she shall furnish the Library with periodic medical reports. The duration of pregnancy leave without pay shall be determined subsequent to the request of the attending physician. Sick leave shall be allowed for the actual time of disability due to pregnancy as certified by the employee's physician.

Section 9. Inclement Weather. If in the event of inclement weather as determined by the Library, an employee misses work either because he/she is late reporting or leaves early or because the Library has determined that its facilities will not be opened, the employee may choose one of the following options: 1) Make up the time at straight time, 2) Use a floating holiday, 3) Use vacation. If these alternatives are not used within the same or subsequent pay period, the time lost shall be considered authorized unpaid leave of absence.
Article XIII - Unauthorized Absence
No employee may absent himself from duty during regular working hours without the permission of the Library. Any employee absenting himself without permission shall be subject to disciplinary action.
Article XIV - Hours of Work
Section 1. The normal work week for permanent full-time employees shall consist of forty (40) hours, Monday through Sunday, except from Memorial Day to Labor Day when the standard work week shall be thirty-seven (37) hours. The normal work day shall be eight (8) hours per day.
Section 2. The normal work week for permanent part-time employees shall be Monday through Sunday. The thirty-seven (37) hour work week, as outlined in Section 1, shall be pro rated for permanent part-time salaried employees. The normal work day shall be a portion of the eight (8) hour day as outlined in Section 1 of the article.
Section 3. The Library reserves the right to determine the business day and week of the facility. Further, the Library may change employees from one regular schedule of days and/or hours to another schedule of days and/or hours in the best interest of the Oshkosh Public Library.

The employer agrees not to reduce the benefits during the life of the contract. Changes in the participation of health care providers listed on any preferred provider list shall not be viewed as a reduction in benefits.
The City may, from time to time, change the medical benefit plan administrators, PPO provider, or method of funding for health coverage if it elects to do so. At least 30 days advance notice of any change in the medical benefit plan administrator, PPO provider or method of funding shall be provided to the Union. Whenever the city is considering any of these changes, the Union may provide input into the decision. This input is limited to advisory only and will not affect the City's responsibility to select a provider or administrator.
Section 6. The parties agree that the additional hours which an employee may work during the months of June, July and August, beyond those which they had been normally scheduled, shall not be computed to cover any additional hospital insurance premium contributions, paid by the employer, or to be considered being a "change of status." Unless otherwise specified in this Agreement, the employer will pay no hospitalization or health insurance premium for any salaried or hourly employee working less than 3/8 time. For the purpose of this article, 3/8 time shall mean a job scheduled for an average of sixty-five (65) hours per month and 1/2 time shall mean a job scheduled for an average of eighty-five (85) hours per month.
Article XVII - Life Insurance
The Library agrees to pay the full cost of the present life insurance policy in effect. Wisconsin Group Life Insurance Policy rules shall govern. Effective January 1, 2002, the Library shall pay 100% of the premium of the Basic Plan of the Wisconsin Public Employer's Group Life Insurance Program. Other amounts of coverage for the employee, and spousal and dependent coverage shall be available to the employee at his/her own expense.

Article XVIII - Income Continuation Insurance
The Library participates, with the City of Oshkosh, in the Wisconsin Department of Employee Trust Fund's Income Continuation Insurance Program. The Library pays the employer's share. Participant cost is based on the previous year's average monthly earnings and the employee's selected elimination period of 30, 60, 90, 120, or 180 calendar days. At the 180-day elimination period, the participant shall have no cost to participate in the program.
Article XIX - Section 125 Plan
Effective January 1, 2002, the City shall select the administrator and offer a Section 125 Plan as allowed by law. Employees will be allowed to contribute premium contributions, unreimbursed medical expenses, and dependent care expenses into the plan subject to the plan's rules and regulations.
Article XX - Wisconsin Retirement System
Section 1. In addition to the statutory requirements, effective January 1, 1996, the Library agrees to pay up to 6.5% of the employee's gross annual salary toward the employee's mandatory contribution to the fund.
Article XXI - Fair Share Agreement
Section 1. The employer agrees that effective January 1, 1998, it will deduct from the monthly earnings of all salaried employees in the collective bargaining unit the amount equal to two (2) hours per month. The employer also agrees to deduct from the monthly earnings of all hourly employees a fixed amount as established by the Union. The employer shall pay said amounts to the treasurer of the Union on or before the end of the month following the month in which said deductions were made.
Changes in the amount of dues to be deducted shall be certified by the Union forty-five (45) days before the effective date of the change.
As to new employees, such deduction shall be made from the employee's first paycheck from which fair share is deducted from all other employees.The employer will provide the Union with a list of employees from whom such deductions are made with each monthly remittance to the Union.
It is further agreed that the Union, as the exclusive representative of all employees in the bargaining unit, will represent all such employees, union and non-union, fairly and equally, and all employees in the unit will be required to pay, as provided in this article, their proportionate share of the costs of representation by the Union. No employee shall be required to join the Union, but membership in the Union shall be made available to all employees who apply consistent with the Union Constitution and Bylaws. No employee shall be denied Union membership because of race, creed, color or sex.
The Union and Council 40, AFSCME, AFL-CIO, do hereby indemnify and shall save the Library harmless against any and all claims, demands, suits, or other forms of liability including court costs that shall arise out of or by reason of action taken, or not taken, by the Library, which Library action or non-action is in compliance with this agreement, and in reliance on any lists or certificates which have been furnished to the Library pursuant to this Article, provided that the defense of any such claims, demands, suits, or other forms of liability shall be under the control of the Union and its attorneys. However, nothing in this section shall be interpreted to preclude the Library from participating in any legal proceedings challenging the application or interpretation of this Article through representatives of its own choosing and at its own expense.

Article XXII - Pay Periods
Section 1. Monthly salaried employees shall be paid on every other Friday by 9:00 a.m.
Section 2. Hourly paid employees shall be paid on every other Friday by 9:00 a.m.
Article XXIII - Wages
Section 1. Employees shall be compensated within the pay range set forth in the salary schedule attached hereto and in accordance with the rules for administration.
Section 2. Employees required to work between 9:00 p.m. and 7:00 a.m. shall receive $.25 per hour extra for all such hours worked unless an employee requests the time.
Section 3. Pages will be paid an additional $0.25 per hour (separate from the wage schedule) that will be construed as a parking permit. Receipt of this parking premium shall be subject to the rules of the Library.

The amount of longevity will be prorated for permanent part-time employees.
Section 2. The following longevity plan is to be put into effect February 1, 2004. Actual payment of longevity earned shall be in December of each year.

$62.50 per month after the 15th year of service
$83.33 per month after the 20th year of service
$93.00 per month after the 25th Year of service
The amount of longevity will be prorated for permanent part-time employees.
These longevity amounts shall be prorated in 2004 to reflect 11/12ths of the amounts in Section 2.
Section 3. Employees with five to ten years of service as of February 1, 2004, shall continue to receive longevity as shown in Section 1 until they reach their 10th year of service. They will then only receive longevity as shown in Section 2.
Employees with 10 to 15 years of service as of February 1, 2004, shall continue to receive longevity as shown in Section 1 as well as Section 2 until they reach their 15th year of service. They will then only receive longevity as shown in Section 2.

Employees with 15 to 20 years of service as of February 1, 2004 shall continue to receive longevity as shown in Section 1 as well as Section 2 until they reach their 20th year of service. They will then only receive longevity as shown in Section 2.
Employees with 20 or more years of service as of February 1, 2004 shall continue to receive longevity as shown in Section 1 as well as Section 2.
Article XXVII - Scope of Negotiations
Section 1. It is agreed between the parties of this contract that the clauses, provisions, or portions set forth in this agreement constitute the scope of negotiation for the period of the contract.
Article XXVIII - Duration
This agreement shall become effective January 1, 2004, and shall remain in full force and effect until and including December 31, 2006, and shall be automatically renewed from year to year unless negotiations are instituted by August 1, of any subsequent effective year.
Article XXX - Management Rights
The Union recognizes that, subject to the express provisions of this agreement, the supervision, management, and control of the Library's business, operation, and facilities are exclusively the function of Library Management.
The Union also recognizes that the Library has the right to subcontract work provided no present employees are laid off or have their hours reduced due to the subcontracted work. The right to subcontract work shall also not be used to undermine the Union or to discriminate against any of its members.
